Unless the military balance shifts, talk of diplomacy is little more than an excuse to ignore atrocities and red lines. The choice is not between diplomacy and greater U.S. involvement. Without the latter, the former will fail.

To watch U.S. and Russian diplomatic efforts regarding Syria, one is tempted to view developments related to Obama’s decision to “work through the Russians” one more time, just as the U.S. did this time last year, as a kind of historical “instant replay”.
Unfortunately, what is occurring now is immensely more serious than what happened last year. History has not stood still. The situation in Syria is infinitely worse than it was a year ago, bad as it was then.
What many perceived as the risks of U.S. inaction, of the U.S. not leading at all, not even from the rear, have in large degree materialized.
The risk that extremists allied with Al-Queda might assume a commanding position among the insurgents has materialized in the form of the al-Nusra Front and other groups.
The risk that the conflict might spill over into other countries and become a regional conflict is increasingly being realized, as Hezbollah militia members fight alongside al-Assad’s Syrian army forces in al-Qusair, exerting such extraordinary pressure on Lebanon that the latter could itself explode in civil war within the next year.
Iran, perhaps emboldened by Obama’s failure to back his word regarding the “red line” of chemical weapons with actions when that line was crossed, now have trainers in Syria, and are very much engaged in the conflict, providing arms, intelligence, and advice.
A year ago it was argued that the U.S. should intervene in part because that would cause a severe setback to Iran. The opposite has occurred. U.S. passivity and inaction have handed Iran a victory, and emboldened it in its support of the al-Assad regime. Indeed, Hesbollah, which is highly dependent on Iran, may have sent its fighters to Syria at the Iranians’ request. It is hard to discern a thread of logic that would justify such an action within the Lebanese political context.
The risks of Israel, the U.S. and Russia getting drawn into the conflict have also increased, and begun to materialize.
On May 3-5, Israel conducted air strikes within Syria which were reportedly aimed at destroying a shipment of Fateh-110 missiles, which are medium-range advanced guided missiles capable of hitting targets at a range of up to 300 kilometers.
The first strikes were on May 3-4.

President Obama argued that the air strikes (if they occurred) were justified. Haaretz reported,
Obama, in an interview with the Spanish-language network Telemundo as part of a three-day Latin America tour that ended in Costa Rica, would not comment on whether the strikes had in fact taken place.
“I’ll let the Israeli government confirm or deny whatever strikes that they’ve taken,” he said.
But Obama, who visited Israel in March, made clear such strikes would be justified.
“What I have said in the past and I continue to believe is that the Israelis justifiably have to guard against the transfer of advanced weaponry to terrorist organizations like Hezbollah. We coordinate closely with the Israelis recognizing they are very close to Syria, they are very close to Lebanon,” he said. (emphasis added)

Subsequent to Obama’s statement, Israel unleashed a second attack within Syria reportedly aimed at destroying the missiles.

Worth noting in passing is the fact that the U.N. Charter and international law do not permit anonymous attacks on another country for which no legal justification is given. Moreover, Obama’s argument, for the Israelis, stretches the right of self-defense recognized by Article 51 of the U.N. Charter far beyond the breaking point, as that right in international law is limited to situations where an armed attack “occurs”.
Russia has been reported as shipping ground to sea missiles to Syria (known as “Yakhonts”), and as being on the verge of shipping a new, more sophisticated air defense system and missiles (known as S-300) to Syria.

With Israel bombing arms shipments destined for Hezbollah within the territory of Syria, Russia delivering ground to sea missiles to the al-Assad regime, and Russia threatening to ship S-300 advanced missile defense systems to Syria, the risk of a direct confrontation bwtween Israel, Russia and/or the United States is substantial.
Wars often happen by accident, it may be useful to recall.
The other risk of playing the Russians’ diplomatic game in 2013, like the U.S. did in 2012, is that another 50,000 people, or more, may be killed in the coming year.
This, however, appears to be the least of the considerations being taken into account in Washington.
Russia is pushing the peace conference and negotiations with Bashar al-Assad because it limits the ability of the U.S. and other countries who oppose him to mount any kind of military action that might actually shift the balance against al-Assad and help bring the fighting and his commission of war crimes and crimes against humanity to a halt.
The Russians now appear to have decided to engage in a more direct confrontation with the United States, introducing substantial military assets for Syria into the mix. They, like the Iranians, may be starting to think that al-Assad can murder his way out of the current situation, and retain his hold on power. This has always been al-Assad’s preferred–and perhaps only–solution.
With Hesbollah and Israel directly entering the fray, the risks of playing the Russians’ diplomatic game, which provides Obama with diplomatic cover for his continuing inaction, are becoming very great indeed–and potentially explosive.

Introduction to the REPRISE (May 7, 2013)
So, Obama’s “red line” on the use of chemical weapons in Syria turns out to be a red line that leads directly to the Kremlin.
What American diplomacy has failed to achieve, spectacularly, Obama and Secretary of State John Kerry now think they can achieve by talking to Putin and Lavrov.
Well, maybe. But hardly likely. Lavrov and Putin now achieve their goal of holding the conference Kofi Annan conjured up as one of his last “castles in the sky” at the conference held at Geneva on June 30, 2012.
How this will stop the killing in Syria is anyone’s guess.
It is just words, words to get Obama off the hook for his “red line” comment, which have come back to haunt him now that al-Assad has used chemical weapons in Syria.
Now that Obama is once again seeking a solution by going to the Russians, who have steadfastly supported al-Assad in his commission of war crimes and crimes against humanity, we can all breathe a sigh of relief. See the following Reprise from the Trenchant Observer to understand just how pitiful this last move by Obama and “the gang who couldn’t shoot straight” is.
Sadly, our hopes in John Kerry seem to have been misplaced. He appears now to have joined “the gang who couldn’t shoot straight”. His role will be to do Obama’s bidding. Obama will continue to control foreign policy from the White House, guided by assistants such as Ben Rhodes.
If this course is not corrected, the disasters of Obama’s first term are likely to be repeated, on a much grander scale with much graver consequences.

In a front-page article in today’s New York Times, Helen Cooper and Mark Landler describe the thinking behind President Obama’s policy towards Syria. They report,
WASHINGTON — In a new effort to halt more than a year of bloodshed in Syria, President Obama will push for the departure of President Bashar al-Assad under a proposal modeled on the transition in another strife-torn Arab country, Yemen.
The plan calls for a negotiated political settlement that would satisfy Syrian opposition groups but that could leave remnants of Mr. Assad’s government in place. Its goal is the kind of transition under way in Yemen, where after months of violent unrest, President Ali Abdullah Saleh agreed to step down and hand control to his vice president, Abdu Rabbu Mansour Hadi, in a deal arranged by Yemen’s Arab neighbors. Mr. Hadi, though later elected in an uncontested vote, is viewed as a transitional leader.
The success of the plan hinges on Russia, one of Mr. Assad’s staunchest allies, which has strongly opposed his removal.

President Obama, administration officials said,
will press the proposal with President Vladimir V. Putin of Russia next month at their first meeting since Mr. Putin returned to his old post on May 7. Thomas E. Donilon, Mr. Obama’s national security adviser, raised the plan with Mr. Putin in Moscow three weeks ago.
Donilon, who is not a seasoned diplomat, apparently did not impress Putin, judging by the latter’s cancellation of his participation in the G-8 summit at Camp David on May 18-19.
The biggest problem with the Yemen model, several experts said, is that Yemen and Syria are starkly different countries. In Yemen, Mr. Saleh kept his grip on power for three decades by reconciling competing interests through a complex system of patronage. When his authority collapsed, there was a vice president, Mr. Hadi, who was able to assert enough control over Yemen’s splintered security forces to make him a credible transitional leader.
In Syria, by contrast, Mr. Assad oversees a security state in which his minority Alawite sect fears that if his family is ousted, it will face annihilation at the hands of the Sunni majority. That has kept the government remarkably cohesive, cut down on military defections and left Mr. Assad in a less vulnerable position than Mr. Saleh. Even if he leaves, American officials conceded, there is no obvious candidate to replace him.
The sheer incompetence of this White House on foreign policy matters is stunning.
Paradoxically, among a number of news commentators within the Washington bubble, Obama is viewed as doing pretty well on foreign policy, particularly since taking out Osama Bin Laden. None of these commentators are foreign policy experts with any experience, however. Further, Democratic foreign policy experts have largely held their silence, probably out of concern that criticism could help the Republicans in the November elections. Moreover, Obama has since his first days in office charmed the press, and many reporters and commentators are simply unwilling to criticize the administration on foreign policy issues in any fundamental way.
Significantly, the Washington Post, which is the one newspaper read by most government officials in Washington, has simply failed to cover Syria with a reporter, usually being content to just run the AP wire story. What contributions they do make are limited in the main to stories providing information by administration officials, named and unnamed.
The Editorial Board, on the other hand, has written some clear-minded editorials on Syria. The disconnect betwee the Editorial Board and the reporting side of the newspaper is hard to understand, especially in view of the Post’s illustrious history.
Despite the reputed “successfulness” of the administration’s foreign policy leadership–which analytically does not stretch beyond the fact that it has not become an issue which hurts the Obama in the presidential race, the utter lack of serousness of Preident Obama and the White House on Syria is exposed for all to see in today’s New York Times article by Cooper and Landler.
Washington’s response to Moscow’s callous support of al-Assad as he killed thousands of people through war crimes and crimes against humanity is on a par with Éduoard Daladier’s and Neville Chamberlain’s betrayal of Czechoslovakia in October, 1938, when they signed “the Munich Pact”.
One of the first betrayals on Syria was with Turkey:
Secretary Clinton caught her Turkish counterpart off guard during their meeting in Washington last month. Clinton reportedly told Foreign Minister Ahmet Davutoglu that the Obama Administration “preferred going through the Russians” in an attempt to achieve a political solution being shopped by the UN/Arab League’s Special Syrian Envoy Kofi Annan.

The reader is invited to read the Observer’s recent articles on Syria, and to draw his or her own conclusions as to whether Obama, Donilon, Clinton and the rest of the administration’s foreign policy team are conducting a competent foreign policy, first of all in Syria, but also everywhere else.
In the Observer’s opinion, this team is “the gang who couldn’t shoot straight”. For example, the Sixth Summit of the Americas, held in Cartagena, Colombia on April 14-15, was totally overshadowed by the prostitution scandal involving members of the Secret Serivce and the U.S. military. Little press attention was given to the substance of the meeting, the most important of the year with the leaders of the Latin American countries.

Now, on the Syrian question, by following a path of “working through the Russians”, the Obama administration has given up its last shred of moral legitimacy in the Middle East. Between al-Assad, Russia, China, and Iran, on the one hand, and the people of Syria, Turkey, Qatar, Saudi Arabia and other Arab countries, on the other, and in the face of immense human suffering and the ongoing commission of war crimes and crimes against humanity by the al-Assad regime, the United States is pursuing a strategy of “working through the Russians.”
Obama is incompetent as a foreign policy leader. Former Ambassador Marc Ginsberg is to be congratulated for his moral courage in speaking out on the question of Syria, in a clear voice.
What the United States needs, desperately, is for other foreign policy experts–and national leaders–to speak out with equal clarity, be they aligned with the Democratic Party in the United States, with the Republicans, or from other countries that are friends of the United States.
In the meantime, the international community would do well to look elsewhere than to the United States for leadership on the Syrian question.

The situation in Syria (is) unfolding “in front of our eyes”, with the regime deploying fighter jets against the people, in addition to heavy artillery and tanks, (Ahmet DAVUTOĞLU, the Foreign Minister of Turkey, told the Security Council on August 30). “How long are we going to sit and watch while an entire generation is being wiped out by random bombardment and deliberate mass targeting?” he asked. “If we do not act against such a crime against humanity happening in front of our eyes, we become accomplice to the crime,” he warned.
As we wrote following the August 30 meeting of the Security Council,
Everyone wants a ceasefire and an end to the killing. Few seem to have come to grips with the fact that the use of force will be required, outside the framework of the Security Council. There can be little doubt that, within the Security Council itself, there is not going to be any agreement to use force (or even to adopt strong economic sanctions) to bring al-Assad’s barbarism to a halt.
This will have to be done outside the framework of the Security Council. What is needed is for one or more countries, preferably but not necessarily acting as a coalition, to just act to set up the safe zones, and one or more accompanying no-fly zones if that is required as a result of al-Assad’s response.

Such action should be accompanied by a justification under international law.
That justification should stress that the purpose of the action is to protect the population of Syria against the commission of war crimes and crimes against humanity.
The stated purpose of the operation should not be to overthrow the government of Bashar al-Assad, which is impermissible under international law. On the other hand, it would be permissible if an operation which protected the population against the commission of such crimes also facilitated a process that would bring to account those in Syria who are responsible for the commission of war crimes and crimes against humanity.
While such fine distinctions may seem of little significance to those not versed in international law, they are in fact quite important in terms of limiting the precedent that would be set and obtaining support from other countries for such action, if not immediately at least over time.

The critical issue with respect to legal justifications for establishing and defending “safe zones” or “no-kill zones” in Syria, and the establishment of no-fly zones if required, is whether such action would violate Article 2 paragraph 4 of the United Nations Charter. Article 2(4) provides:
Article 2
The Organization and its Members, in pursuit of the Purposes stated in Article 1, shall act in accordance with the following Principles.
…
(4) All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations.
On the face of it, the use of force to enforce a no-fly zone, or to defend a “safe zone” from assaults by Syria’s army, would involve an action against the “territorial integrity” of Syria. This is the horn of the dilemma.
Read literally, any permanent member of the Security Council could, through the use of its veto, block any military action by any state within the territory of another state, except in the case of an “armed attack”, no matter what the circumstances. In principle, such a veto could block any action by the civilized nations of the world to bring to a halt a war crimes and crimes against humanity, ethnic cleansing such as occurred in Kosovo, or even genocide such as that conducted by Adolph Hitler during World War II.
Various interpretations of the Charter have proposed ways out of this logical box. One is the so-called “teleological” interpretation, by which Article 2(4) must be interpreted not literally, but rather in the light of the general purposes of the U.N. Charter and its other principles. Using this approach, one might justify the establishment of “no-kill zones” and “no-fly zones” in Syria.
The problem is that such “teleological” interpretations might open Pandora’s box, allowing multiple interpretations and opportunities for abuse by states intervening for their own purposes, e.g., to overthrow the al-Assad regime, while putting a humanitarian argument forward to justify their actions. Or, to cite another example, Israel and the United States might attempt to justify an attack on Iran to take out or greatly degrade its nuclear enrichment capabilities and what they believe is a secret program aimed at developing nuclear weapons, on the rationale that it is necessary to maintain international peace and security.
Alternatively, Israel and the United States could in principle attempt to justify an attack on Iran as an exercise of the right of individual and collective self-defense, an exception to the prohibition in Article 2(4) contained in Article 51 of the Charter, which provides:
Article 51
Nothing in the present Charter shall impair the inherent right of individual or collective self-defence if an armed attack occurs against a Member of the United Nations, until the Security Council has taken measures necessary to maintain international peace and security. Measures taken by Members in the exercise of this right of self-defence shall be immediately reported to the Security Council and shall not in any way affect the authority and responsibility of the Security Council under the present Charter to take at any time such action as it deems necessary in order to maintain or restore international peace and security.
The key words in Article 51 are “if an armed attack occurs”, which has been interpreted as embodying the requirements that the armed attack have occurred or be imminent, immediate and leave no time for other actions. Exercise of the right of self-defense has traditionally been subject to the requirements “immediacy, necessity and proportionality”.

The United States and other nations have not always acted within this tight legal framework. In 1999, for example, the United States and NATO conducted a unilateral bombing campaign against Serbia in a successful effort to get the government to stop its policy of ethnic cleansing in Kosovo. Despite its humanitarian purpose, no legal justification was advanced by the U.S. Department of State for the action.
In Iraq, the United States sought to justify its 2003 invasion of that country both on the basis of previous Security Council resolutions and on the basis of the “right” advanced by the Bush administration to “pre-emptive self defense”.
The concern of states and legal scholars from around the world is that by allowing “teleological” interpretations of Article 2(4) or expansive interpretations of what constitutes “an armed attack” creating a right of individual and collective self-defense, such interpretations would open the door to increasingly expansive assertions of the right to use force across international frontiers. It is significant that in the case of Kosovo, no legal justification was offered.
So, we are left with the legal regime brilliantly defined by the founders of the United Nations to establish rules and mechanisms to effectively regulate the international use of force, on the one hand, and the fact that as the populations of more and more countries seek to demand respect for their fundamental human rights, and the right to participate in government, existing dictorships may resort to the appalling use of terror and crimes against humanity and war crimes in defending their hold on power, as has happened recently in Libya and Syria.
Unlike domestic laws and the constitution in the U.S., the United Nations Charter and other international agreements are subject to rules of strict interpretation, as established in the Vienna Convention on the Law of Treaties. This makes sense, as nations are generally extremely wary of ceding authority to international institutions, and rules of strict interpretation are necessary in order to secure participation in international treaties. While the United Nations Charter is something of a special case, since very few countries would consider withdrawal from the organization, acceptance of the compulsory jurisdiction of the International Court of Justice remains voluntary, a fact which underlines the continuing importance of rules of strict interpretation.
Caught in this logical box, are we to stand idly by as tens of thousands or hundreds of thousands of human beings are slaughtered, whenever a permanent member of the Security Council exercises a veto?
The United Nations Charter is 67 years old. It has survived the Korean war, the war in Vietnam, the invasions of Hungary, Czechoslovakia, and Afghanistan (1980), the Balkan wars, genocide in Rwanda and the Sudan, and the U.S. invasion of Iraq.
The fundamental question is whether states should: (1) simply act outside the charter when they feel compelled to do so for humanitarian reasons (e.g., Kosovo); (2) justify their actions on legal grounds, preferably as taken with the support of regional organizations (e.g., NATO) or a broad coalition of nations; or (3) do nothing in the face of acts of barbarism such as those being committed in Syria.
In the case of Kosovo, Russia brought a resolution to a vote in the Security Council which condemned the bombing of Serbia, but the resolution was defeated 12-3.
Perhaps that is as close to 100% compliance with the Charter norms as we can get in the world today.
The ultimate choice is between undertaking effective action that will halt the atrocities in Syria, or sticking with our current policies.
In the case of the U.S., the current policy is carefully calibrated to comply with the requirements on the use of force laid down by the International Court of Justice in 1986 in the Nicaragua case. In that case, the Court held that direction and control of rebel groups was required in order for assistance to rebel groups to constitute an armed attack, thereby triggering a right of individual or collective self defense.
If the decision is made to establish safe zones and associated no-fly zones (if necessary), a final choice is whether to provide some legal justification for such action, or to follow the example of the United States in the NATO bombing of Serbia in 1999, and offer none.
While the choice here is not entirely clear, a strong argument can be made for advancing a highly restrictive legal justification, narrowly tailored to the circumstances in the Syrian case, together with the support of a regional body such as NATO, and undertaken only as a provisional measure of protection until such time as the Security Council can act effectively to protect the population of Syria from the commission of war crimes and crimes against humanity.
Russia may bring a resolution condemning such action in the Security Council. Assuming the resolution is defeated by a healthy margin, as occurred in the case of Kosovo, this may be the closest to compliance with the Charter as is possible today.

With the Muslim Brotherhood’s recent coup d’etat in Egypt, following on other measures it has taken in the last year, a dark pall has fallen over the Middle East.
A historic failure of U.S. leadership has not been the only cause, but it has left the advocates of modernity and democracy without a champion.
It is tragic that President Obama and the United States have not spoken out strongly, unequivocally, for restoration of the rule of law in Egypt.
Historians will have to sort out the causes of the decline of the influence of the West in the Middle East in the last few years, but surely American disinterest and unwillingness to get involved–in solving the Palestinian issue, or dealing with the barbarism of Bashar al-Assad in Syria–will weigh heavily in their accounts. With the United States in retreat since at least March of 2011, the region has been falling into anarchy and the hands of Islamic parties which, collectively, could potentially lead to the establishment of Islamic dictatorships throughout the region. Egypt is of extraordinary significance, for it is the cultural capital of the Arab world.
We are currently witnessing what happened in Iran–as it is actually happening, day by day, in Egypt.
The democratic promise of the Arab Spring, including the overthrow of tyrannical regimes in Tunisia and Libya, has not engendered the financial and other support from the West and other countries that might have helped sustain it, something like a Marshall plan for the New Democracies of the Middle East.
As the Muslim Brotherhood and Mohamed Morsi have just executed a coup d’etat in Egypt, the West—including the United States—stands leaderless, paralyzed, unable to react or to attempt to influence the rush of events in that country.
The United States and the West could consider blocking a $4.8 billion standby loan agreement between the IMF and Egypt, for example, if Morsi does not rescind his constitutional decree and the Brotherhood’s headlong race toward adoption of a constitution without the support of non-Islamic parties. But no one in Washington seems to be paying attention or to be thinking that fast.
Students of history may recall that Adolph Hitler came to power through free elections, but moved swiftly to control or eliminate potential opponents through a process known as the em>Gleichschaltung), or forced coordination.
Above all, the failure of the United States to openly lead a coalition to halt Bashar al-Assad’s atrocities in Syria has resulted in a loss of respect and influence in the region, while producing a covert program of supplying arms to the Syrian rebels through deeply conservative regimes whose interests seem to lie not in democracy, but in defeating Shia’s and empowering conservative and Islamist Sunni militias.
The cumulative policy failures and ongoing withdrawal from Afghanistan, leaving that country in conditions whose dire consequences are likely to be felt, if not immediately at least in the not-too-distant future; and the strategic failure in Iraq to achieve the administration’s central goal of a status of forces agreement–when the U.S. had leverage–and the resultant withdrawal of all U.S. forces leaving the gains from that war to unravel, have given the impression that the West is in retreat, contributing to a sense of impending doom.
Hamas celebrates victory as a result of the Egyptian-brokered truce agreement following its bombardment of Israel with rockets and Israel’s response, while Palestine is granted U.N. Observer status at the U.N., an implicit recognition of a Palestinian state achieved not through negotiation with the Israelis, but through negotiations in the corridors of the U.N.
Everywhere, supporters of democracy and modernity seem to be suffering a sharp decline in fortunes and influence. Unwilling to take a stand for their values in Syria, U.S. and Western supporters should perhaps not be too surprised now as those values are pushed aside.
The Benghazi fiasco is emblematic of the failure of U.S. policy in the region. Its significance is that, like a wartime flare on a dark night, it illuminates the administration’s policy failures throughout the Middle East, how they are connected, and how their consequences are all coming together as they did in Benghazi on the night of September 11, 2012.
The situation is ominous. One is reminded of the “The Second Coming”, William Butler Yeats’ celebrated poem written after World War I, which reads as follows:

Intelligence agencies use deception as a standard operating procedure. CIA operations are by nature secret, and intelligence agencies go to great lenghts to keep them secret, even if their existence sometimes may be leaked if it suits the president’s purposes.
It should come as no surprise, therefore, that the reporting by American reporters on the Benghazi attacks has been mostly based on off-the-record interviews with administration officials, and that the latter have presented their revelations and confirmations in ways which pursue their own objectives, on background, usually on deep background where even the agency of the source is not revealed. Such reporters seem quite content to simply pass on the latest “revelations”, without vetting them against other known facts and statements. Often, it does not add up.
The constantly evolving narrative of the CIA “talking points” used by Susan Rice on the Sunday talk shows on September 16 illustrates the confusion of such spinning by intelligence officials whose modus operandi is deception and secrecy. First we learn that the so-called talking points were drafted by the CIA. Then we learn they were changed by someone, but all the intelligence chiefs testified that they didn’t know by whom. Then we learn that the CIA draft was not changed by the intelligence agencies, but sent up to the NSC Deputies Committee. Wednesday we learn that the DNI now says that they edited the talking points, as did other agencies.
None of the edits were necessary for national security reasons, in the original opinion of the CIA. Intelligence officials on background justify their edits on the grounds that leaving in the references to al-Queda affiliates and sympathizers would have revealed methods and sources, thereby revealing methods and sources.
On Wedneday, Susan Rice reiterates that she only told the talk shows what was in the talking points. The media fail to point out that she also included references in her statements on those shows to “armed individuals” and “small groups of armed individuals” in an effort to stress the disorganized nature of the attack, when such presumably classified information was not in her “talking points”.
The first duty of a journalist used to be to get to the bottom of things, to sort out all the conflicting evidence and tell the audience what it means, not simply to pass it on. The Washington press corps has, by and large, failed to get to the bottom of things. That is why, two months and 11 days after the attacks at Benghazi, we the public still don’t know for sure exactly what happened, or exactly what the CIA black operation was doing in Benghazi.
Were they providing arms to the Syrian rebels?
The press has failed, spectacularly, to provide an answer to this question, which lies at the heart of the Benghazi affair.They have done so, presumably, because they were asked to withhold those details by the Obama administration’s intelligence agencies. With very few and limited exceptions, the fact that they have published no further details about the CIA’s black operation in Benghazi demonstrates the extent to which the Washington press corps has become a servile instrument of the Obama administration’s foreign policy.
The fact that the administration was able to control the media’s reporting of the CIA’s black operation in Benghazi should be a matter of extraordinary concern to citizens of a free country who are utterly dependent on a free press, and a free press which to be meaningful must aggressively seek out and publish the facts even when the government wants to keep them secret.
Indeed, more broadly, there has been precious little fundamental criticism of Obama’s foreign policies and the details and quality of their implementation.
What were the CIA’s operatives doing in Benghazi?
The answer is of overriding importance for the development and implementation of an effective U.S. foreign policy. From a policy perspective, there is a fundamental question of whether the nation’s interests have been served by Obama’s covert operations relating to Syria, or would have been better served by an open and public policy of support for those forces in Syria who are seeking to bring to an end al-assad’s barbarism, involving widespread commission of war crimes and crimes against humanity. Such attacks have not been seen in a modern state at least since the Balkan wars of the 1990′s, and possibly since the atrocities of the German Nazi state of Adolph Hitler before and during World War II.
Some 40,000 Syrians have died as a result of the inaction of the international community, and the failure of leadership of the Obama administration. Obama has even blocked the efforts of other states to bring force to bear to halt Bashar al-Assad’s assault on the civilization and people of Syria.
Quite simply, the United States has failed to lead, and whatever beneficial results it has achieved through covert operations have come at a heavy cost. The Saudi defense minister is reportedly playing a key role in coordinating the covert supply of weapons to the Syrian opposition, just as he did with respect to supplying the insurgents in Afghanistan in the 1980′s following the Soviet invasion of that country, when he was ambassador to Washington. We are still dealing with the “blowback” from that operation, as the war in Afghanistan grinds on in its 11th year.
It should come as no surprise that Islamist groups are benefitting from this arrangement at the expense of more secular groups. This is a direct result of the U.S. pursuit of a covert policy in Syria, instead of an open policy that might have led to early confrontation with al-Assad and the saving of tens of thousands of lives.
The spill-over effects of this covert war are being felt throughout the region. Hamas was emboldened by the visit of the leader of Qatar in recent weeks. A looming confrontation between Syria and Turkey, with NATO involvement in supplying Patriot missiles to Turkey while Russia vehemently objects, demonstrations in Jordan including calls for the end of the monarchy, and a continuing threat against the independence of Lebanon, are only some of the knock-on effects of Obama’s covert policy and lack of leadership on Syria. The press has a crtical role to play in guaranteeing that this occurs. Its job is to search out the truth and to report it to its readers and its electronic audience. That truth, and only that truth, can guide the nation in choosing a wise and effective foreign policy.

The situation in Syria (is) unfolding “in front of our eyes”, with the regime deploying fighter jets against the people, in addition to heavy artillery and tanks, (Ahmet DAVUTOĞLU, the Foreign Minister of Turkey, told the Security Council on August 30). “How long are we going to sit and watch while an entire generation is being wiped out by random bombardment and deliberate mass targeting?” he asked. “If we do not act against such a crime against humanity happening in front of our eyes, we become accomplice to the crime,” he warned.
As we wrote following the August 30 meeting of the Security Council,
Everyone wants a ceasefire and an end to the killing. Few seem to have come to grips with the fact that the use of force will be required, outside the framework of the Security Council. There can be little doubt that, within the Security Council itself, there is not going to be any agreement to use force (or even to adopt strong economic sanctions) to bring al-Assad’s barbarism to a halt.
This will have to be done outside the framework of the Security Council. What is needed is for one or more countries, preferably but not necessarily acting as a coalition, to just act to set up the safe zones, and one or more accompanying no-fly zones if that is required as a result of al-Assad’s response.

Such action should be accompanied by a justification under international law.
That justification should stress that the purpose of the action is to protect the population of Syria against the commission of war crimes and crimes against humanity.
The stated purpose of the operation should not be to overthrow the government of Bashar al-Assad, which is impermissible under international law. On the other hand, it would be permissible if an operation which protected the population against the commission of such crimes also facilitated a process that would bring to account those in Syria who are responsible for the commission of war crimes and crimes against humanity.
While such fine distinctions may seem of little significance to those not versed in international law, they are in fact quite important in terms of limiting the precedent that would be set and obtaining support from other countries for such action, if not immediately at least over time.

The critical issue with respect to legal justifications for establishing and defending “safe zones” or “no-kill zones” in Syria, and the establishment of no-fly zones if required, is whether such action would violate Article 2 paragraph 4 of the United Nations Charter. Article 2(4) provides:
Article 2
The Organization and its Members, in pursuit of the Purposes stated in Article 1, shall act in accordance with the following Principles.
…
(4) All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations.
On the face of it, the use of force to enforce a no-fly zone, or to defend a “safe zone” from assaults by Syria’s army, would involve an action against the “territorial integrity” of Syria. This is the horn of the dilemma.
Read literally, any permanent member of the Security Council could, through the use of its veto, block any military action by any state within the territory of another state, except in the case of an “armed attack”, no matter what the circumstances. In principle, such a veto could block any action by the civilized nations of the world to bring to a halt a war crimes and crimes against humanity, ethnic cleansing such as occurred in Kosovo, or even genocide such as that conducted by Adolph Hitler during World War II.
Various interpretations of the Charter have proposed ways out of this logical box. One is the so-called “teleological” interpretation, by which Article 2(4) must be interpreted not literally, but rather in the light of the general purposes of the U.N. Charter and its other principles. Using this approach, one might justify the establishment of “no-kill zones” and “no-fly zones” in Syria.
The problem is that such “teleological” interpretations might open Pandora’s box, allowing multiple interpretations and opportunities for abuse by states intervening for their own purposes, e.g., to overthrow the al-Assad regime, while putting a humanitarian argument forward to justify their actions. Or, to cite another example, Israel and the United States might attempt to justify an attack on Iran to take out or greatly degrade its nuclear enrichment capabilities and what they believe is a secret program aimed at developing nuclear weapons, on the rationale that it is necessary to maintain international peace and security.
Alternatively, Israel and the United States could in principle attempt to justify an attack on Iran as an exercise of the right of individual and collective self-defense, an exception to the prohibition in Article 2(4) contained in Article 51 of the Charter, which provides:
Article 51
Nothing in the present Charter shall impair the inherent right of individual or collective self-defence if an armed attack occurs against a Member of the United Nations, until the Security Council has taken measures necessary to maintain international peace and security. Measures taken by Members in the exercise of this right of self-defence shall be immediately reported to the Security Council and shall not in any way affect the authority and responsibility of the Security Council under the present Charter to take at any time such action as it deems necessary in order to maintain or restore international peace and security.
The key words in Article 51 are “if an armed attack occurs”, which has been interpreted as embodying the requirements that the armed attack have occurred or be imminent, immediate and leave no time for other actions. Exercise of the right of self-defense has traditionally been subject to the requirements “immediacy, necessity and proportionality”.

The United States and other nations have not always acted within this tight legal framework. In 1999, for example, the United States and NATO conducted a unilateral bombing campaign against Serbia in a successful effort to get the government to stop its policy of ethnic cleansing in Kosovo. Despite its humanitarian purpose, no legal justification was advanced by the U.S. Department of State for the action.
In Iraq, the United States sought to justify its 2003 invasion of that country both on the basis of previous Security Council resolutions and on the basis of the “right” advanced by the Bush administration to “pre-emptive self defense”.
The concern of states and legal scholars from around the world is that by allowing “teleological” interpretations of Article 2(4) or expansive interpretations of what constitutes “an armed attack” creating a right of individual and collective self-defense, such interpretations would open the door to increasingly expansive assertions of the right to use force across international frontiers. It is significant that in the case of Kosovo, no legal justification was offered.
So, we are left with the legal regime brilliantly defined by the founders of the United Nations to establish rules and mechanisms to effectively regulate the international use of force, on the one hand, and the fact that as the populations of more and more countries seek to demand respect for their funamental human rights, and the right to participate in government, existing dictorships may resort to the appalling use of terror and crimes against humanity and war crimes in defending their hold on power, as has happened recently in Libya and Syria.
Unlike domestic laws and the constitution in the U.S., the United Nations Charter and other international agreements are subject to rules of strict interpretation, as established in the Vienna Convention on the Law of Treaties. This makes sense, as nations are generally extremely wary of ceding authority to international institutions, and rules of strict interpretation are necessary in order to secure participation in international treaties. While the United Nations Charter is something of a special case, since very few countries would consider withdrawal from the organization, acceptance of the compulsory jurisdiction of the International Court of Justice remains voluntary, a fact which underlines the continuing importance of rules of strict interpretation.
Caught in this logical box, are we to stand idly by as tens of thousands or hundreds of thousands of human beings are slaughtered, whenever a permanent member of the Security Council exercises a veto?
The United Nations Charter is 67 years old. It has survived the Korean war, the war in Vietnam, the invasions of Hungary, Czechoslovakia, and Afghanistan (1980), the Balkan wars, genocide in Rwanda and the Sudan, and the U.S. invasion of Iraq.
The fundamental question is whether states should: (1) simply act outside the charter when they feel compelled to do so for humanitarian reasons (e.g., Kosovo); (2) justify their actions on legal grounds, preferably as taken with the support of regional organizations (e.g., NATO) or a broad coalition of nations; or (3) do nothing in the face of acts of barbarism such as those being committed in Syria.
In the case of Kosovo, Russia brought a resolution to a vote in the Security Council which condemned the bombing of Serbia, but the resolution was defeated 12-3.
Perhaps that is as close to 100% compliance with the Charter norms as we can get in the world today.
The ultimate choice is between undertaking effective action that will halt the atrocities in Syria, or sticking with our current policies.

(1) Die Zeit (Berlin) reported on August 27, in an article by Martin Gehlen, that military intervention in Syria is “absolutely essential” (unverzichtbar).
Syria is on the way to Hell. With or without the U.N. Security Council, whether they want to risk it or not: the international community in the foreseeable future will have to intervene.
Gehlen reports that each day more horrible crimes are committed, as the number of refugees exceeds the capacity of neighboring states to absorb them–30,000 crossed the border last week alone. Some two million refugees are fleeing, both inside and outside the country, while hundreds of thousands of families are trapped between the front lines.
But above all, Gehlen asserts, it is the stocks of chemical weapons that will require intervention, if al-Assad uses them in the civil war, or to keep them from falling into the wrong hands. They cannot just be left to themselves.
The international community will also have to provide food and shelter for the refugees, who can’t just go home as their homes have been destroyed, together with their schools and their hospitals.
In the meantime, Gehlen writes, the United States, Turkey and France are preparing, for the first time, to establish limited no-fly zones. The United States is bringing into position special forces for chemical weapons, and planning large-scale distribution of food and medicines. What is clear, he concludes, is that whatever responsibilities for Syria may come to the international community, they will be more comprehensive, last much longer, and be far more costly than the 7,587 NATO air-raids against Libya.

(3) Last week, on August 23, the Pentagon ordered one of its aircraft carriers, the USS Stennis, previously scheduled to be deployed in the Pacific, to return to the Persian Gulf in view of the situation in Iran and also that in Syria. The early deployment cut short short home leaves.
Panetta cited Iran’s nuclear program and its threats to oil tankers in the Strait of Hormuz as two concerns the Stennis strike group could counter in the U.S. Central Command’s area of responsibility, which also includes Syria and Afghanistan.
U.S. attention on Syria is focused on providing humanitarian aid, monitoring chemical and biological weapon stockpiles, and offering non-lethal assistance to forces opposing President Bashar al-Assad, he said.

The administration’s current policy involves intensifying diplomatic and economic pressure on Mr. Assad’s government through sanctions, offering humanitarian assistance to Syrians inside and outside the country, and providing $25 million in “nonlethal” help to Mr. Assad’s opponents, including more recently to members of the Free Syrian Army. That aid has paid for communication equipment to enable the armed and unarmed opposition to better coordinate their attacks and plans for taking power.
The administration has also ruled out providing arms to the rebels for broadly the same reason: more weapons, the officials say, would probably make the war only worse.
The idea that supplying more weapons for the rebels would make the war only worse, when they are being slaughtered by the instruments of war of a modern state including attack helicopters, jet fighters, artillery and tanks, while they themselves are running out of ammunition (as reported recently in Aleppo), is nothing short of obscene, revealing a callousness that is almost beyond belief.
That, however, is the policy of the American president, Barack Obama, and his foreign policy juggernaut, “the gang who couldn’t shoot straight.”

If you’ve ever attended a conference at the Commodore Hotel or walked near the American University in West Beirut, or had a drink at a lively bar or eaten lunch in Ashrafiieh, in East Beirut, you may have some sense of the charms of Lebanon and its capital city. If you’ve driven around Beirut and seen the way the center of the city near the Green Line has been rebuilt following the long civil war (1975-1990), or witnessed the variety of religious beliefs represented in the dress of women at one of the busy shopping malls, and seen how despite their differences Lebanese seem to manage getting along with each other, you may have some idea of their achievement in building a country with a working democracy and a strong civil society, after a devastating civil war, in a place where the tectonic plates of Islamic and Christian civilizations come together.
And if you’ve ever studied a little bit of Lebanon’s history, from the development of the alphabet at Byblos and the Phoenicians to the Romans and the Crusaders to the present, and particularly since the landing of U.S. marines in 1958 to stabilize the existing order and the sudden withdrawal of U.S. marines on a separate mission, following the deaths of 241 American marines and 58 French servicemen from a truck bombing at their headquarters in Beirut in 1983, you may have some sense of the delicate balance of forces at play in Lebanon, and the careful efforts of the Lebanese themselves to avoid a return to civil war. Nor do they wish to return to the enforced peace which existed under Syrian occupation until the Syrians were forced to withdraw following the assassination of Rafiq Hariri in 2005. The Syrian withdrawal resulted from what came to be known as “the Cedar Revolution”, led by forces now known as “the March 14 Alliance” (not to be confused with their opponents, the “the March 8 Alliance”).
The government, representing a finely-balanced equilibrium between opposing alliances, seems perennially on the verge of collapse. Before the Arab Spring reached Syria and exploded into civil war as a result of Bashar al-Assad’s use of terror in attempting to suppress it, a huge issue which threatened political stability in the country was whether the government would pay its share of the expenses of the international Special Tribunal for Lebanon set up by the United Nations to investigate and prosecute those responsible for the Hariri assassination. This became a burning issue when it became known that the Tribunal was planning to issue, and then issued, indictments against members of Hezbollah for their involvement in the Hariri assassination. Somehow, through a number of crises, the Lebanese were able to work out a solution to this problem. Lebanon paid its share of the Tribunal’s budget without Nasrallah, Hezbollah’s leader, bringing down the government or even seizing control of Beirut’s southern suburbs (and other parts of the city) and the southern part of the country, in addition to the Bekaa Valley, which through his actions he had threatened to do in the past. Somehow, Lebanon muddled through.
Culturally, Lebanon has played a very special role in the Arab imagination, a fact reflected in many Egyptian films, as a romantic and holiday destination. It is also known as a place of personal and intellectual freedom where individuals of different nationalities and political, religious and ethnic backgrounds can come together, in order to meet, exchange ideas, negotiate, and enjoy the vibrant music and cultural scene. Lebanon’s cultural life is now broadcast through the Arab world by satellite television channels including LBC.
The love songs and melodies of Farouz, perhaps the best known singer in the Middle East in the last 50 years, are known throughout the Arab world and beyond.
Yet the toll of the Lebanese Civil War on the people of Lebanon was horrendous.
Now, the carefully constructed peace and political balance in Lebanon, built on the ruins of that war, is in great danger of being rendered by the raging forces of the civil war in Syria, which has recently spilled over into Tripoli and northern Lebanon. Moreover, the former Lebanese Minister of Information, Michel Samaha, has been arrested with explosives on charges he brought explosives into Lebanon with the intent of bombing crowds and assassinating Sunni leaders supportive of the Free Syrian Army, in coordination with Syrian intelligence officials.

This spill-over has been largely due to the passivity of the West and the Arab countries and the civilized nations of the world, in the face of Russian and Chinese blocking actions in the U.N. Security Council. The West and their allies have shown an appalling lack of resolve in standing up to the terror in Syria orchestrated by Bashar al-Assad, with material and political support from Russia, Iran and China.
If the West and the Arab countries and Turkey had intervened early with the calibrated use of military force to halt al-Assad’s atrocities, would the civil war have reached its current dimensions or intensity?
Revealingly, Dimitri Simes, a well-known Russian expert, stated on the PBS Newshour on June 13, 2012, that he had just had a number of conversations in Moscow with key officials, and had come away with the clear impression that if the West and the Arab countries were to intervene with military force, the Russians would not be happy and would complain loudly, but in the end would be prepared to accept the fact of the intervention.
DIMITRI SIMES:
Let me say, however, again something Michele Dunne said which I find quite interesting, and I don’t know whether she had it in mind, but perhaps she did, namely, that nobody said we’re not entitled to act without U.N. Security Council blessing. And as one official in Moscow put it to me, well, look, if the United States feels very strongly that force has to be used and is determined to act, let the United States and NATO do it without U.N. Security Council blessing, the way it has happened in the case of Kosovo, the way it has happened in Iraq.
The Russians obviously would criticize that. They wouldn’t want a decision which doesn’t give a role to the U.N. Security Council. But if that is the only way to resolve the situation, I think they would be prepared to live with that.

Even if Simes’ assessment was accurate at the time, the Russian position has since evolved sharply to one of direct confrontation with the West.
The civil war in Syria is like a large and growing forest fire which outsiders have decided to allow to grow in intensity and extension, hoping that it will burn itself out before it consumes their homes and livestock and other precious goods.
But the fire has shown no signs of burning itself out. On the contrary, every day it seems to find new and endless supplies of dry underbrush and dry wood to feed its fury.
This fire could spread to Lebanon very easily. Some of its flames have already lapped across the borders. The only questions are whether the fire marshals, who have up till now been steadily explaining why they cannot intervene without knowing which way the fire will go and ultimately who will dominate the ruins it leaves behind, will call in the fire brigades to halt its advance, and if so when.

The mediation mission of Kofi Annan has turned into a hydra-headed monster that the United States, France and the United Kingdom do not seem to have the courage to slay as it begins to rise up again, out of the the smoldering ashes of Kofi Annan’s total defeat, his total failure, as U.N.-Arab Joint Special Envoy.
The mediation mission of Kofi Annan directly served the interests of the Russians and the Bashar al-Assad regime itself, by endlessly proposing empty rhetorical solutions to the Syrian conflict, “castles in the sky” which were beautiful indeed and elicited universal approval, but which were not accompanied by any practical steps or path for their achievement in reality. It was, as we observed, as if the nations of the world became ectstatic over the fact that they had achieved complete unity, on the proposition that all points on a circle are equidistant from the center.
But “Kofi Annan’s triumph”, the mediation mission and its oversized staff and budget, has acquired life and the kind of blind bureaucratic momentum that keeps new offices and missions moving in the U.N. without the intervention of human thought. It represents the creation of what amounts to a second secretary general’s office in Geneva charged with mediating in Syria, to be sure, but also keeping high-ranking diplomats employed, a total of some seventeen staff, at U.N. salary rates for an Undersecretary ($189,000 tax-free), two Assistant Secretaries ($172,000 each, tax-free) and other U.N. diplomats of high rank to assist these principal figures.
A successor to Kofi Annan, and this mighty staff based on Geneva, would help ensure that the U.N. Special Envoy and his operation will remain at the center of international decision-making on Syria, sucking up the world’s media attention as it did when Annan was leading the operation, to the exclusion even of coverage of events on the ground.
It represents Russia’s attempt to get back in the game, after blocking all efforts at effective Security Council action. Without the Joint Special Envoy and his operation, and UNSMIS, the Russians become largely irrelevant as the locus of decision making shifts away from the Security Council–for at least so long as al-Assad’s butchery continues.
We have seen how the Joint Special Envoy’s enterprise was used to do the Russians’ bidding, and to set loose unaccountable U.N. diplomats on an endless quest to, among other things, maintain their own salaries and positions, even if that involved attempting to drag Iran into the existing mess.
Kofi Annan failed. Absolutely. His mediation mission produced nothing. Absolutely nothing. It dragged out the period of time in which the world’s nations stood by, paralyzed by false promises and false hopes. Thousands, certainly over 10,000, were killed in Syria as a result.
Kofi Annan’s mission achieved one key objective for the Russians: it succeeded in forestalling any forceful military action by outside countries that might have actually brought al-Assad’s atrocities to a halt.
The mission was premised on the assumption that if Bashar al-Assad were to agree to a peace plan, or to anything for that matter, that agreement would have some value, that it would mean something. However, even in February, it was already quite clear from the failed Arab League peace mission in 2011 that this assumption was utterly flawed.
Kofi Annan’s greatest and most shameful failure was that after it had become manifest that al-Assad would not honor the 6-point peace plan to which he had agreed, Annan did not report back to the Security Council on the failure of his mission. Instead, he continued to negotiate, to waste time, to blind the world community with the beauty of his “palaces in the sky”, while al-Assad continued to use his tanks, his artillery, and his army to massacre the civilian population of Syria. Kofi Annan constantly held out the hope of some agreement, as he negotiated with a war criminal who was committing war crimes and crimes against humanity against his people every day.
As if this shame were not enough, Secretary General Ban Ki-Moon responded quickly to the Russian entreaties that a successor to Kofi Annan be named as soon as possible. The Russians pushed hard for this, while the Americans did not think clearly and did not strongly oppose this action, which today is reported to be imminent.
All of this is being done without any public discussion or analysis or apparent thought, other than to satisfy the demands of the Russians and the Chinese, whose interest in forestalling effective action by the Security Council–or by anyone else–has been demonstrated beyond the slightest doubt.
Ban Ki-Moon’s appointment of Kofi Annan as Joint Special Envoy was one of the greatest blunders in modern U.N. history. Now, this idea, which is based on the assumption that agreement with al-Assad on anything would have meaning, and the fundamentally flawed concept that it is OK to negotiate with a war criminal while he is committing war crimes and crimes against humanity, is on the verge of a second incarnation with the appointment of a new Joint Special Envoy.
We have spoken before of the folly of subsuming the voices of the Arab countries in the person of a Joint U.N.-Arab League Special Envoy. There is absolutely no objective benefit to be derived by dragging the Arab League into this appointment, which only gives the Arab League an excuse for doing nothing. The Arab countries that make up the League of Arab States have a role to play through that organization, as well as outside of it. Their voices should not be stifled again with another appointment of a “Joint Special Envoy”.
Secretary General Ban Ki-Moon is turning out to be a disaster in his leadership on the Syrian issue. Not only did he initially appoint Kofi Annan, as the outcome of a secretive process the details of which were never made clear, but he also dismissed General Robert Hood unceremoniously at the end of the first 90 days of his contract as commander of UNSMIS. This he did without a word of thanks that reached the world’s attention. Nor did he explain why Hood was fired (technically, he didn’t offer Hood an extension of his contract, without explanation, which amounted to the same thing).
We speculated earlier about the possibility that Hood was replaced for standing up too energetically for the security of his monitors, and ordering them to stand down because of both security concerns and the impossibility of monitoring a non-existent truce. Hood’s replacement, Lieutenant General Babacar Gaye, suddenly appeared on the scene in Damascus on July 30 together with Hervé Ladsous, U.N. Assistant Secretary for Peacekeeping, and promptly ordered patrols by the UNSMIS observers. He was never properly introduced, and details of his background and why he was chosen to replace Hood were never provided in a way that caught the attention of the world’s press.

The manner in which Ban Ki-Moon replaced General Robert Hood as head of UNSMIS, in view of his distinguished and courageous service, was shameful and scandalous. The way the Secretary General is now proceeding to appoint a successor to Kofi Annan without public discussion, without an open discussion in the Security Council, is equally scandalous.
Why the Obama administration would go along with this move, which is so clearly contrary to its interests and those of all the countries which are willing to act to halt the atrocities in Syria, is just one more of the foreign policy mysteries of Barack Obama.
It seems that the U.S. foreign policy decision-making apparatus is shut down for the summer, and possibly until after the U.S. elections in November. Secretary of State Hillary Clinton has become the Peer Gynt of modern diplomacy, traveling the world with her entourage of high state department officials, far from the centers of decision making where policies and actions are in fact decided. President Barack Obama is lost in the campaign, and appears to have little interest in or attention for anything else. Leon Panetta, the Secretary of Defense, has in Clinton’s absence been pressed into service as a foreign policy spokesman for the administration, but not always with felicitous results. Tom Donilon, the National Security Adviser, is apparently holding down the fort, though even he was recently dispatched to Israel to carry Obama’s messages to Netanyahu. All in all, we are left with “the gang who couln’t shoot straight” as they continue their happy wandering through the unfocused foreign policy terrain of a president who is not minding the store.
Hillary Clinton has seized upon this time to see the many countries of the world, which is probably a much more pleasant place to be than to be in Washington, ignored.
If there remains a single foreign policy leader who is awake and alert, whether in Washington, Paris, or London, he or she should act with the utmost urgency to block any appointment of a successor to Annan, and to stop any continuation of his mission and the U.N. bureaucratic boondoggle of what amounts to a second secretary general’s office in Geneva to support it
The world has tried the Kofi Annan act, and experienced the massive loss of lives and the bitter disappointment and total defeat that it has brought.
We don’t need to go there again.
Anyone who thinks the Russians are acting out of any but the basest motives in seeking to resurrect this diplomatic instrument, which was so helpful to them over the last four months, should review with his colleagues the evidence that has accumulated over the last 17 months in relation to Syria.

The U.N. Security Council adopted a draft resolution sponsored by the United Kingdom, France, and Germany on Friday morning, July 20, 2012, extending the term of the UNSMIS for a final period of 30 days. The resolution provided, further, that this extension should not be renewed unless the Secretary General reports and the Security Council confirms “the cessation of the use of heavy weapons and a reduction in the level of violence by all sides sufficient to allow UNSMIS to implement its mandate.”

The resolution was adopted by a unanimous vote. The full text of resolution 2059 (2012) reads as follows:
The Security Council,
Commending the efforts of the United Nations Supervision Mission in Syria (UNSMIS),
1. Decides to renew the mandate of UNSMIS for a final period of 30 days, taking into consideration the Secretary-General’s recommendations to reconfigure the Mission, and taking into consideration the operational implications of the increasingly dangerous security situation in Syria;
2. Calls upon the parties to assure the safety of UNSMIS personnel without prejudice to its freedom of movement and access, and stresses that the primary responsibility in this regard lies with the Syrian authorities;
3. Expresses its willingness to renew the mandate of UNSMIS thereafter only in the event that the Secretary-General reports and the Security Council confirms the cessation of the use of heavy weapons and a reduction in the level of violence by all sides sufficient to allow UNSMIS to implement its mandate;
“4. Requests the Secretary-General to report to the Council on the implementation of this resolution within 15 days;
“5. Decides to remain seized of the matter.”
Significantly, the United States was not a co-sponsor of the resolution, in view of the fact that it initially opposed an extension for UNSMIS.
It is simply not credible to argue that the mere continuation of an unarmed observer mission in the midst of these threats and spiraling violence can or will fundamentally change anything. Everyone in this room knows that. The United States has not and will not pin its policy on an unarmed observer mission that is deployed in the midst of such widespread violence and that cannot even count on the most minimal support of this Security Council. Instead, we will intensify our work with a diverse range of partners outside the Security Council to bring pressure to bear on the Assad regime and to deliver assistance to those in need. The Security Council has failed utterly in its most important task on its agenda this year. This is another dark day in Turtle Bay.
One can only hope that one day, before too many thousands more die, that Russia and China will stop protecting Assad and allow this Council to play its proper role at the center of the international response to the crisis in Syria.

Pakistan, in collaboration with Russia, had sponsored a competing draft resolution for the extension of UNSMIS for 45 days, with no conditions.
Analysis
This weeks’ negotiations and votes at the United Nations represented highly significant developments.
The sponsors and supporters of draft resolution S/2012/538, vetoed by China and Russia on July 19, made very significant progress in spelling out the conditions that will be necessary for the Security Council to act effectively in Syria in the future. The adoption of Resolution 2058 today, with stringent conditions for any future renewal of UNSMIS, demonstrates their resolve not to continue passively as Kofi Annan creates endless illusions regarding “agreements” which have no teeth and no consequences for violating their provisions. In this sense, the Kofi Annan-Russia-Syria game of endless delay while atrocities continue, is over.
The focus of attention will now shift to the actions of nations outside the famework of the Security Council. This is a highly positive development, and represents the only way the kind of real pressure that can stop al-Assad can be organized and brought to bear on the ground.
At some point in the future, when Russia and China realize that by their vetoes they have marginalized themselves from the efforts of the civilized nations of the world to bring the atrocities in Syria to a halt, and to manage the transition that will follow al-Assad’s inevitable departure, the Security Council may play a constructive role.
Vladimir Putin, who increasingly seems to emulate the foreign policy brilliance of Leonid Brezhnev, has dictated a Russian policy on Syria for which in the end Russia will pay dearly.
Russia, as a result of its bull-headed obstinacy in the Security Council proceedings on Syria, has lost something of inestimable value: the trust and goodwill of the American political leadership class.
There are signs that not only Secretary of State Hillary Clinton now understands the necessity of tougher action toward Russia, but that even Barack Obama is beginning to awake from his dream and illusion of a “reset” of U.S. relations with Russia. His meeting with Putin in Los Cabos, Mexico on the sidelines of the G-20 summit may also have helped in this regard.
Further, the United States House of Representatives has adopted a draft law which would ban U.S. government business with Russia’s arms manufacturers. It will now be sent to the Senate. The significance of this development is very great: Russia has lost the goodwill and the trust of a large segment of the American population, including the Republican party. This is likely to have long-lasting and far-reaching repercussions, from throwing into doubt the repeal of the Johnson-Vanik amendment and the approval of permanent most-vavored-nation treatment status (now called PNTR status), to making it very difficult if not impossible to achieve ratification of any future START or other arms agreement between and Russia and the United States.

In the Middle East itself, Russia’s short-sighted policies in Syria are likely to cause resentments that become crystallized into a template of anti-Russian feeling that could last for a generation or more. Not only are they likely to lose Syria as an ally, but also to find it increasingly difficult to exercise influence among the other Arab nations of the region.
China, too, will pay a price over the long term for having acted to block Security Council action on Syria. While it may calculate that its foreign assistance to Africa will win the favor of African states, to the extent necessary to extract the natural resources that it seeks, as the democratic revolution spreads throughout Africa China’s defense of the commission of war crimes and crimes against humanity will be remembered. It will be remembered elsewhere as well.
To be sure, the fact that China is in a year of political transition during which the leadership of the country for the next 10 years will assume power may cause all of the leaders in China to exercise extreme caution. In this context, they may calculate that hiding behind Russia is the safest course, politically, within China. But just as the United States may pay a high price for an inept and non-responsive foreign policy, however “good” it may be judged in terms of the domestic political and electoral dynamic, China too is likely to pay a significant cost abroad for its obstruction of Security Council action.
Pakistan’s and South Africa’s Abtentions on July 19
The two countries that abstained on the draft resolution vetoed on July 19 deserve special mention. Pakistan’s abstention, wholly aside from its fatuous justification for its vote, signals even greater alienation from the U.S., and a willingness to cooperate with the Russians when the interests of the superpower and the former superpower collide. The collaboration with Moscow was quite evident in the draft resolution Pakistan sponsored for an extension of UNSMIS with no conditions, i.e., on Russian terms.
This development is worrisome, because together Pakistan and Russia could have a decisive influence over the way things go in Afghanistan. It is also troubling because Pakistan is still a democracy of sorts, with nuclear weapons, and its alignment with the League of Authoritarian States would cause very significant problems down the road.
As for South Africa, given its previous support for the February 4, 2012 draft resolution in the Security Council vetoed by China and Russia, what are we to make of its abstention on the vote on the draft resolution vetoed on July 19?
South African Deputy Foreign Minister Ebrahim Ebrahim has offered a not very persuasive defense of South Africa’s vote. Governments voting in the Security Council are sophisticated, and they do not approve or oppose a resolution of such great importance because some phrase or wording they proposed was rejected. The South Africans knew very well what was at stake in their vote on this resolution, and their abstention is deeply worrisome.

Significantly, it should be noted that at the time of the vote on July 19, South African President Jacob Zuma was in Beijing attending a conference of Chinese and African leaders at which China pledged some $20 billion of economic assistance to Africa over the next three years. Did Zuma abstain out of deference to his hosts, or is there more to it?
South Africa’s shift from supporting U.N. resolutions condemning the al-Assad regime to abstention in voting on the draft resolution of July 19 is a matter of great concern, both to countries supporting transitions to democracy and the rule of law in Africa and in general, and to the many countries in Africa which look to South Africa as a shining example–exemplified by Nelson Mandela–of the kind of democracy that Africans can achieve.
Nkosazana Dlamini-Zuma, current Home Affairs Minister and former foreign minister of South Africa (and also a former wife of president Jacob Zuma), has just been elected as the head of the Commission of the African Union, underlining the fact that South Africa’s influence is and will be felt far and wide on the continent.

Paradoxically, one of the first questions Dr. Dlamini-Zuma will have to address, will be the position of the African Union in requesting (or not) U.N. Security Council intervention in Mali to help stabilize the country after an out-break of civil war there. What the South African vote of abstention on July 19 says about the Mali question, if anything, is of great importance.
More broadly, whether South Africa aligns with democratic movements and reformers stuggling for the rule of law will, over time, have a very large impact on events on the continent, both outside and within South Africa itself.
In Syria the fighting intensifies, as do the risks in the region
Meanwhile, back on the ground in Syria, it was reported that over 300 people were killed on Friday, July 20.

Events are moving quickly, and the crisis in Syria is not getting better. The United States is, however belatedly, now examining military options for protecting the chemical weapons in al-Assad’s control in the event he uses them or his control over them breaks down, as well as how to deal with the possibility that Israel might undertake attacks against chemical weapons facilities.

With the issue of Iran’s development of a nuclear weapons capability in drift, and earlier threats by Israel to bomb Iran’s nuclear sites before their window of inevitability closed, the question of Syria lies at the heart of the cauldron of interests that are now engaged in the Middle East. Presidents Obama and Putin would do well to reread Barbara Tuchman’s The Guns of August on the events in 1914 that accidentally set off World War I. In a recent column, David Ignatius has made the same point.

It is time for President Obama and the key members of his team, including in particular cabinet secretaries, to pay close attention, day by day, to what is going on in Syria and the region. He has been slow to appreciate the significance of developments in the past, or we would never have reached this point. He must now support those who can understand the requirements of the critical situations we face and act decisively to achieve clear and coherent objectives. Paying attention, and making sure others pay full attention, is one task he cannot delegate, whatever the demands of the electoral cycle.
